These Terms of Service (the "Terms") govern your access to and use of the BookBolt mobile application (the "App"), including any content, functionality, and services offered on or through the App.
By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not download, access, or use the App.
References in these Terms to "BookBolt", "we", "our", or "us" refer to the provider of the App. References to "you" or "user" refer to any individual who accesses or uses the App.
1.1 These Terms constitute a legally binding agreement between you and BookBolt concerning your access to and use of the App. These Terms apply to all users of the App, regardless of the manner in which the App is accessed.
1.2 By downloading, installing, accessing, or using the App in any manner, you agree that you have the legal capacity to enter into these Terms and that you are bound by them. Your use of the App is also conditioned on your acceptance of, and compliance with, these Terms.
1.3 If you do not agree to these Terms, or if you do not have the authority or capacity to agree to them, you must not download, install, access, or use the App, and you must immediately uninstall the App from any device on which it is installed.
1.4 BookBolt may make the App available via third-party platforms or app stores. Your use of such platforms or stores may also be subject to the terms and policies of the relevant third party, which are separate from these Terms.
2.1 Eligibility. You may use the App only if you are of the legal age required to form a binding contract in your place of residence, or have obtained the consent or authorization of a parent, legal guardian, or other authorized person who has the legal capacity to agree to these Terms on your behalf. By using the App, you represent and warrant that you meet the applicable eligibility requirements.
2.2 Account Requirement. Certain features or functionalities of the App may require you to create or sign in to a user account (an "Account"). BookBolt may, from time to time, enable or restrict features that require an Account, and may modify the scope of such features.
2.3 Third-Party Sign-In. The App currently allows you to create or access an Account by using third-party authentication services, such as sign-in with Google or Apple. When you use these sign-in methods, authentication is performed by the relevant third-party provider, and the App may receive certain information from that provider (such as your name and email address) as described in the applicable Privacy Policy.
2.4 Accuracy of Information. You agree that any information provided to us in connection with your use of the App and your Account (including information obtained from third-party sign-in providers) will be accurate, current, and complete to the best of your knowledge, and that you will promptly update such information as necessary so that it remains accurate, current, and complete.
2.5 Account Management. You are responsible for any activity that occurs under your Account, whether or not authorized by you, to the extent permitted by applicable law. BookBolt may, but is not obligated to, impose limits on the number of Accounts that you may create or maintain.
2.6 Right to Refuse or Cancel. BookBolt reserves the right, in its sole discretion and where reasonably appropriate, to refuse to create an Account for you, to restrict or cancel your access to the App, or to suspend or terminate your Account, including where there is a reasonable belief of violation of these Terms, fraud, abuse, or misuse of the App, or a risk to the security, integrity, or proper functioning of the App or to other users.
3.1 Account Security. You are responsible for maintaining the security of your device and any credentials or methods used to access your Account (including your Google or Apple login credentials). You must not share your login details or authentication methods with any other person, and you must promptly notify the relevant third-party provider and cease use of the App if you suspect any unauthorized access to your Account or device.
3.2 Compliance with Terms and Law. You agree to use the App only in accordance with these Terms and any laws, rules, and regulations that apply to your use of the App, your conduct, and any content you access or interact with through the App.
3.3 Prohibited Conduct. You agree that you will not, and will not attempt to, directly or indirectly:
3.4 Responsibility for Use. To the extent permitted by applicable law, you are solely responsible for your use of the App, any content or information you access, provide, or share through the App, and any consequences arising from your actions or omissions in connection with your use of the App.
3.5 Reporting Misuse. If you become aware of any misuse of the App, including any violation of these Terms, or any security incident, you are encouraged to report it to us through the contact options available within the App.
4.1 Third-Party Authentication. The App enables you to sign in or create an Account using third-party authentication services, such as Google and Apple. When you choose to use such methods, your identity is authenticated by the relevant third-party provider, and certain limited information (such as your name and email address) may be shared with us for the purpose of operating and maintaining your Account.
4.2 Third-Party Terms and Policies. Your use of Google, Apple, or any other third-party services in connection with the App is subject to the separate terms of service and privacy policies of those third parties. You are responsible for reviewing and complying with all such applicable third-party terms and policies.
4.3 No Responsibility for Third Parties. BookBolt does not control, and is not responsible for, the availability, security, accuracy, functionality, or practices of any third-party services, including Google or Apple. To the maximum extent permitted by applicable law, BookBolt will not be liable for any acts or omissions of such third parties, or for any loss or damage arising from your use of or reliance on any third-party services.
4.4 Changes to Third-Party Services. Third parties may modify, suspend, or discontinue their services at any time. BookBolt does not guarantee that any particular third-party sign-in or integration will continue to be available, and may modify or discontinue such integrations at any time without prior notice, where reasonably appropriate.
5.1 Ownership of the App. The App, including but not limited to its overall design, user interface, features, functionality, software code, text, graphics, images, audio, video, and other materials and content (collectively, the "App Content"), is owned by or licensed to BookBolt and is protected by intellectual property and other rights.
5.2 Limited License to You. Subject to your continued compliance with these Terms, BookBolt grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a compatible device that you own or control, solely for your personal, non-commercial use and only in accordance with these Terms.
5.3 Restrictions on Use. Except as expressly permitted under these Terms or by applicable law that cannot be contractually limited, you must not, and must not permit any third party to:
5.4 Reservation of Rights. All rights not expressly granted to you in these Terms are reserved by BookBolt and its licensors. No rights are granted to you under any patents, trademarks, trade secrets, trade names, or other intellectual property rights, whether by implication, estoppel, or otherwise, except as expressly set out in these Terms.
5.5 User Feedback and Inputs. From time to time, you may provide BookBolt with ideas, suggestions, feedback, or other input regarding the App (collectively, "Feedback"). You acknowledge and agree that you provide any Feedback voluntarily, BookBolt has no obligation to use or respond to any Feedback, and to the maximum extent permitted by applicable law, you grant to BookBolt a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, translate, distribute, and otherwise exploit such Feedback in any manner and for any purpose, including to improve and develop the App and other products or services, without compensation or attribution to you.
5.6 Third-Party Content. The App may display or provide access to content originating from third parties. Such content is the sole responsibility of the person or entity that makes it available. BookBolt does not endorse and is not responsible for third-party content, and your use of or reliance on such content is at your own risk.
6.1 Potential Paid Features. While the App may currently be provided without charge, BookBolt may, in the future, offer certain features, services, content, or functionalities within the App that are subject to fees, including one-time purchases, consumable items, upgrades, or recurring subscription plans (collectively, "Paid Features").
6.2 Presentation of Terms at the Time of Purchase. If and when Paid Features are made available, the applicable pricing, billing details, subscription periods, renewal terms, cancellation options, and any additional terms or conditions will be presented to you within the App at the time you elect to purchase or subscribe. By proceeding with any such purchase or subscription, you agree to the terms displayed at the time of the transaction, in addition to these Terms.
6.3 Billing and Payment Methods. Payments for Paid Features may be processed through third-party app stores, payment processors, or other service providers. You authorize any such third parties to charge you using the payment method you select, in accordance with their applicable terms and policies. You are responsible for ensuring that your payment information is accurate and up to date.
6.4 Subscriptions and Renewals. If you purchase a subscription-based Paid Feature, your subscription may automatically renew at the end of each billing period, unless you cancel before the renewal date, as described in the App and/or by the relevant third-party platform. The renewal terms, including price and duration, will be disclosed to you at the time of initial purchase and, where required, at the time of renewal.
6.5 Cancellations. You may cancel a subscription or recurring Paid Feature in accordance with the instructions provided within the App and/or by the relevant app store or payment platform. Cancellation will take effect at the end of the then-current billing period, and you will continue to have access to the applicable Paid Features until that time, unless otherwise specified in the applicable terms at purchase.
6.6 No Refunds. Unless expressly stated otherwise in the App at the time of purchase or required by applicable law, all fees and charges for Paid Features are non-refundable and non-creditable, including in cases of partial use, non-use, or downgrade. Any refund requests that may be handled by app stores or payment processors are subject to their respective policies.
6.7 Price Changes. BookBolt reserves the right to change the pricing of any Paid Features at any time, to the extent permitted by applicable law and the rules of applicable app stores or platforms. Any price changes for existing subscriptions will be communicated to you in advance within the App and/or by the relevant app store or platform, and will only take effect after the end of the then-current billing period, unless otherwise required by applicable terms or law.
7.1 Privacy Policy. Your use of the App is subject to a separate Privacy Policy, which explains how BookBolt collects, uses, stores, and protects personal information, including any information obtained through third-party sign-in methods such as Google and Apple.
7.2 Reference to Privacy Policy. The Privacy Policy is made available within the App. You should carefully review the Privacy Policy before using the App or providing any personal information. By using the App, you acknowledge that you have read and understood the Privacy Policy and that you agree to the collection, use, and processing of your information in accordance with it.
7.3 Relationship with These Terms. In the event of any inconsistency between these Terms and the Privacy Policy with respect to the treatment of personal information, the Privacy Policy will govern to the extent of such inconsistency, without limiting any broader obligations or responsibilities set forth in these Terms.
8.1 Suspension or Termination by BookBolt. To the maximum extent permitted by applicable law, BookBolt may, in its sole discretion, with or without prior notice, suspend, restrict, or terminate your access to the App, your Account, or any licenses or rights granted to you under these Terms, if BookBolt reasonably believes that you have violated or are likely to violate these Terms, your conduct poses a security risk, legal risk, or other risk to the App, BookBolt, or other users, or such action is appropriate for operational, maintenance, or security reasons.
8.2 Effect of Suspension or Termination. Upon suspension or termination, your right to access and use the App, including your Account and any related features, will immediately cease or be restricted as communicated to you, and you may lose access to certain content or information associated with your Account or your use of the App. To the extent permitted by applicable law, BookBolt is not obligated to maintain, store, or provide you with a copy of any content or data that you have provided or generated through the App, except as required by applicable law or as otherwise described in the Privacy Policy.
8.3 Termination by You. You may stop using the App at any time, and you may delete or uninstall the App from your devices. If you wish to deactivate or delete your Account, you may do so following the instructions available within the App or through the contact options provided in the App. Termination by you does not entitle you to any refunds, except where required by applicable law or explicitly stated otherwise in the App.
8.4 Survival. Any provisions of these Terms that, by their nature, should reasonably be understood to survive suspension, termination, or expiration (including, without limitation, provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and general provisions) shall continue to apply after such suspension, termination, or expiration.
9.1 "As Is" and "As Available". To the maximum extent permitted by applicable law, the App and all App Content are provided on an "as is" and "as available" basis, without any warranties, representations, or conditions of any kind, whether express, implied, or statutory.
9.2 No Warranties. Without limiting the generality of the foregoing, and to the maximum extent permitted by applicable law, BookBolt expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to any implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and accuracy, reliability, or completeness.
9.3 No Guarantee of Availability or Performance. BookBolt does not warrant or guarantee that the App will be uninterrupted, timely, secure, or error-free; that any defects or errors in the App will be corrected; that the App will be compatible with any particular device, operating system, or software; or that any content or information obtained through the App will be accurate, reliable, or complete.
9.4 Use at Your Own Risk. Your use of the App, and any reliance on any content or information made available through the App, is at your sole risk. You are responsible for taking appropriate precautions to protect your devices, systems, and data, including implementing appropriate security measures and backups.
9.5 Third-Party Services. BookBolt does not control and is not responsible for any third-party services, content, or resources that may be integrated with or accessible through the App, including but not limited to third-party sign-in providers. Your use of any such third-party services is at your own risk and subject to the separate terms and policies of those third parties.
10.1 Exclusion of Certain Damages. To the maximum extent permitted by applicable law, in no event will BookBolt be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or your inability to access or use, the App, even if BookBolt has been advised of the possibility of such damages.
10.2 Limitation of Aggregate Liability. To the maximum extent permitted by applicable law, BookBolt's total aggregate liability arising out of or in connection with these Terms or your access to or use of (or inability to access or use) the App will be limited to the total amount of fees actually paid by you for the App or Paid Features during the three (3) months immediately preceding the event giving rise to the claim, or, if you have not paid any fees, to the maximum extent permitted by applicable law.
10.3 Applicability of Limitations. Some laws do not allow the exclusion or limitation of certain damages or the limitation of liability for certain types of claims. Accordingly, some or all of the above exclusions and limitations may not apply to you. In such cases, the exclusions and limitations shall apply to you to the fullest extent permitted by the applicable law.
10.4 Basis of the Bargain. You acknowledge and agree that the disclaimers, exclusions, and limitations set forth in these Terms reflect a reasonable and fair allocation of risk between you and BookBolt, and that these provisions form an essential basis of the agreement between you and BookBolt.
11.1 To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BookBolt, and its affiliates, and their respective officers, directors, employees, and agents (collectively, the "Indemnified Parties"), from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable legal and professional fees) arising out of or in connection with your access to or use of the App, your violation or alleged violation of these Terms, or your violation or alleged violation of any rights of any third party, including any intellectual property or privacy rights.
11.2 BookBolt reserves the right, at its own expense, to assume the exclusive defense and control of any matter that is otherwise subject to indemnification by you, and in such case, you agree to cooperate fully with BookBolt in the defense of such matter, to the extent reasonably requested, without relieving you of your indemnification obligations.
11.3 This indemnification obligation will survive any suspension, termination, or expiration of these Terms or your use of the App.
12.1 Changes to the App. BookBolt may, at any time and from time to time, modify, update, enhance, suspend, or discontinue the App (in whole or in part), including any features, functionalities, or content, for any reason, including for technical, operational, security, legal, or business reasons. Where reasonably practicable, BookBolt will take steps to provide you with notice within the App of any material changes.
12.2 Updates and Upgrades. BookBolt may from time to time provide updates, upgrades, patches, or other modifications to the App (collectively, "Updates") which may be required for continued use of the App. You may be required to install such Updates in order to continue using the App. The App may automatically download and install certain Updates, or prompt you to do so.
12.3 Changes to These Terms. BookBolt may, from time to time, revise or update these Terms. When the Terms are updated, the "Last updated" date at the top of this document will be revised. BookBolt may also provide additional notice of material changes within the App, such as by displaying a notice or requiring you to accept the updated Terms.
12.4 Your Acceptance of Changes. Changes to these Terms will become effective when they are posted in the App or on the location where these Terms are made available, unless otherwise stated. Your continued access to or use of the App after any changes to these Terms become effective will constitute your acceptance of the updated Terms. If you do not agree to any updated Terms, you must discontinue use of the App and uninstall it from your devices.
13.1 Entire Agreement. These Terms, together with the Privacy Policy and any additional terms or conditions that may be presented to you within the App in connection with specific features, constitute the entire agreement between you and BookBolt with respect to your use of the App, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to such subject matter.
13.2 Severability. If any provision of these Terms is held by a court or other competent authority to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall continue in full force and effect.
13.3 No Waiver. No failure or delay by BookBolt in exercising any right, power, or remedy under these Terms shall operate as a waiver of that or any other right, power, or remedy. Any waiver of any provision of these Terms will be effective only if it is in writing and clearly expressed as a waiver.
13.4 Assignment. You may not assign, transfer, or delegate any of your rights or obligations under these Terms, whether by operation of law or otherwise, without the prior written consent of BookBolt. Any attempted assignment in violation of this provision is void. BookBolt may assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, to any third party, including to a successor, affiliate, or as part of a merger, acquisition, reorganization, or other corporate transaction, without notice to you.
13.5 Relationship of the Parties. Nothing in these Terms shall be construed as creating any partnership, joint venture, employment, or agency relationship between you and BookBolt. You and BookBolt are independent contracting parties, and neither party has the authority to bind the other in any respect.
13.6 Interpretation. Headings in these Terms are for convenience only and shall not affect the interpretation of any provisions. Any reference to "including" or similar terms shall be interpreted as "including, without limitation," unless expressly stated otherwise.
13.7 Applicable Law and Dispute Handling. Any disputes, claims, or controversies arising out of or relating to these Terms or your use of the App will be handled in accordance with applicable law. Nothing in these Terms shall deprive you of any mandatory protections afforded to you under the laws that apply to you. The manner, forum, and procedures for resolving any such disputes may be further described in the App or in separate documentation, where applicable.

By continuing to access or use the App, you confirm that you have read, understood, and agree to be bound by these Terms.
